HUMAN RIGHTS COUNCIL HOLDING FOURTH SESSION FROM 12 TO 30 MARCH

The Human Rights Council will hold its fourth session from 12 to 30 March at the Palais des Nations to debate the promotion and protection of human rights around the world.

At the beginning of the session, a high-level segment will be held during which dozens of dignitaries will address the Council. The Council will also hold an interactive dialogue with United Nations High Commissioner for Human Rights Louise Arbour on her annual report.

During the session, the Council will hear the Special Procedures of the Council present their reports. Reports will be presented on the situation of human rights in Burundi, Liberia, the Democratic Republic of the Congo, Myanmar, the Democratic People’s Republic of Korea, and the Occupied Palestinian Territories.

Reports will also be presented on minority issues, effects of economic reform policies and foreign debt on human rights, racism and racial discrimination, extrajudicial, summary or arbitrary executions, freedom of religion or belief, human rights of migrants, protection of human rights while countering terrorism, freedom of opinion and expression, physical and mental health, education, sale of children and child prostitution, indigenous people, torture, violence against women, human rights and transnational corporations, human rights defenders, internally displaced persons, people of African descent, arbitrary detention, and enforced or involuntary disappearances.

The Council’s high-level missions to Darfur and Gaza will present their reports. At its first special session, the Council decided to dispatch an urgent fact-finding mission headed by the Special Rapporteur on the situation of human rights in the Palestinian territories occupied since 1967 and it will have before it the report of the Special Rapporteur (A/HRC/4/116). At its fourth special session, the Council decided to dispatch a high-level mission to assess the human rights situation in Darfur and the needs of the Sudan in this regard and it will have before it the report of the High-Level Mission (A/HRC/4/80). With regards to the Commission of Inquiry on Lebanon which was created after the second special session, the Council will have before it the report of the High Commissioner after consulting with the Government of Lebanon on the mission’s report and its findings (A/HRC/4/115).

Two special events are scheduled to be held during the session: on violence against children and on the Convention on the Rights of Persons with Disabilities.

The Council will continue with its review work of its mechanisms and will hear progress reports from its two intergovernmental working groups on the Universal Periodic Review, and on the review of mandates, which includes segments on the Complaints Procedure, the Expert Advice Body and the Special Procedures.

With regards to the Universal Periodic Review, in resolution 60/251 which created the Council, the General Assembly decided that the Council should undertake a universal periodic review, based on objective and reliable information, of the fulfilment by each State of its human rights obligations and commitments in a manner which ensured universality of coverage and equal treatment with respect to all States. The resolution said the review should be a cooperative mechanism, based on an interactive dialogue, with the full involvement of the country concerned and with consideration given to its capacity-building needs. The Council was asked to develop the modalities and necessary time allocation for the Universal Periodic Review mechanism within one year after the holding of its first session in June 2006.

In resolution 60/251, the General Assembly also decided that the Council should assume, review and, where necessary, improve and rationalize all mandates, mechanisms, functions and responsibilities of the Commission on Human Rights in order to maintain a system of Special Procedures, Expert Advice and a Complaints Procedure. It said the Council should complete this review within one year. The Special Procedures include the Special Rapporteurs, Independent Experts, Working Groups and other bodies. The Expert Advice Body will replace the Sub-Commission for the Promotion and Protection of Human Rights, which held its last session last year. And the Complaints Procedure will replace the so-called 1503 procedures under which situations of violations of human rights are reviewed behind closed doors.

- report of the Special Rapporteur on extrajudicial,summary or arbitrary executions, Philip Alston (A/HRC/4/20 and Add.1 and 2);
- report of the Special Rapporteur on freedom of religion or belief, Asma Jahangir (A/HRC/4/21 and Add.1-3);
- report of the Special Rapporteur on the promotion and protection of human rights and fundamental freedoms while countering terrorism, Martin Scheinin (A/HRC/4/26 and Add.1-3);

Reports Concerning Economic, Social and Cultural Rights

The Council will have before it the following reports:

- report of the Independent Expert on the effects of economic reform policies and foreign debt on the full enjoyment of all human rights, particularly economic, social and cultural rights, Bernards Andrew Nyamwaya Mudho (A/HRC/4/10);
- report of the Special Rapporteur on the right of everyone to the enjoyment of the highest attainable standard of physical and mental health, Paul Hunt (A/HRC/4/28 and Add.1-3);
- report of the Special Rapporteur on the right to education, Vernor Muñoz Villalobos (A/HRC/4/29 and Add.1 and 2);

It will also consider the report of High Commissioner on the right to development; the reports of the Secretary-General on human rights and unilateral coercive measures, on the question of the realization in all countries of the economic, social and cultural rights, and on access to medication in the context of pandemics, such as HIV/AIDS, tuberculosis and malaria; report of the High Commissioner on the promotion of the enjoyment of the cultural rights of everyone and respect for different cultural identities; note by the High Commissioner for Human Rights transmitting the report of the seminar on anti-corruption measures, good governance and human rights, held in Warsaw from 8 to 9 November 2006; the reports of the High Commissioner on the World Programme for Human Rights Education and on human rights and transnational corporations and other business enterprises; and the progress report by the Secretary-General on the protection of human rights in the context of human immunodeficiency virus (HIV) and acquired immunodeficiency syndrome (AIDS).

The Council will have before it the following reports:

- report of the Special Rapporteur on the human rights of migrants, Jorge A. Bustamante (A/HRC/4/24 and Add.1 and 2);
- report of the Special Rapporteur on the sale of children, child prostitution and child pornography, Juan Miguel Petit (A/HRC/4/31 and Add.1 and 2);
- report of the Special Rapporteur on the situation of human rights and fundamental freedoms of indigenous people, Rodolfo Stavenhagen (A/HRC/4/32 and Add.1-4);
